Hell no,\u201d Garlinghouse said, speaking on the CLARITY Act. \u201cThere\u2019s tradeoffs and compromises, but I do think clarity is better than chaos.\u201d The bill, which aims to define regulatory oversight for digital assets and establish clearer rules for industry participants, has already passed the House of Representatives in July 2025 and advanced through the Senate Agriculture Committee in January 2026. Stablecoins, along with tokenized equities and ethics concerns, have been recurring hurdles in the Senate\u2019s discussions. The compromise is seen as a boost for the CLARITY Act, but Garlinghouse stressed that it does not guarantee passage.<\/p>\n<p>Senator Cynthia Lummis, a key member of the Senate Banking Committee, echoed Garlinghouse\u2019s call for action. \u201cThe Clarity Act is not a future priority; it is the priority,\u201d Lummis wrote in a post on X (formerly Twitter). \u201cEvery corner of the industry is operating under legal uncertainty that Congress has the power to fix. The Senate needs to act.\u201d<\/p>\n<h2>Regulators Already Moving Ahead<\/h2>\n<p>Even as the legislative process drags on, U.S. regulators are pushing forward. In March, the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) signed a memorandum of understanding to coordinate oversight of digital asset markets. SEC Chair Paul Atkins has described the agency\u2019s evolving approach to crypto regulation as a \u201cbeginning, not an end,\u201d but noted that clarity from Congress via the CLARITY Act remains essential.<\/p>\n<h2>Why This Matters<\/h2>\n<p>The CLARITY Act is a cornerstone of U.S. efforts to establish a comprehensive regulatory framework for cryptocurrencies. By defining the jurisdictions of the SEC and CFTC, it aims to eliminate the patchwork of rules currently stifling innovation and creating legal uncertainty for market participants. Stablecoin regulation, particularly around yield generation, has been a flashpoint, with some lawmakers concerned about the potential for these products to mimic unregistered securities.<\/p>\n<p>The stakes are high. The U.S. crypto market has grown to a total market cap of $2.77 trillion as of May 5, 2026, and regulatory clarity is seen as critical to maintaining the country\u2019s leadership in digital asset innovation.
